A federal judge has ruled against former Superior Court Judge Ernest B. Murphy in his $6.8 million case against the Boston Herald’s insurer.

In a summary judgment released Wednesday, U.S. District Court Judge Patti Saris ruled there was insufficient evidence that Mutual Insurance Co. “ever exclusively controlled the defense, the appeal, or the settlement” in a dispute between Murphy and the Herald.
